India is party to the Convention on Biological Diversity (CBD) 1992 which recognizes the sovereign rights of states to use their own Biological Resources. In order to help in realizing the objectives of CBD, India has enacted an umbrella legislation called the Biological Diversity Act, 2002 (No.18 of 2003) aimed at conservation of biological resources and associated knowledge as well as facilitating access to them in a sustainable manner
In exercise of the powers conferred by the section 62 of the Biological Diversity Act, 2002, and in supersession of the National Biodiversity Authority (Salary, Allowances and conditions of service of Chairperson and others Members) Rules, 2003 except as respect to things done or omitted to be done before such supersession, the Government of India promulgated the Biological Diversity Rules, 2004.
In exercise of the power conferred by Section 63 of the Biological Diversity Act, 2002 the Government of Arunachal Pradesh has promulgated the Arunachal Pradesh (Biological Diversity) Rules, 2011.
